traffic offences

In Israel

the basic you should know

1. The right of silence

Don’t ask for forgiveness. It may hurt you.

2. More travelers

If you have passengers and they also deny committing the offense, make sure that their words are also recorded. Do not sign the report without reading your response written there. If things have been mistakenly registered, ask the police officer to correct it.

3. careless driving

The police sometimes choose to get worse with a defendant and therefore the indictment should not be rushed and admitted because it may be possible, prior to admission, to diminsh the indictment. In any minor offense as serious as the manslaughter clause is converted into causing negligence (negligent death).

4. Polygraph

Ready in any way to prove your innocence? A private polygraph institute is a good option. If the test is good for you – introduce it to the trial. If not – destroy it and no one will know its results. The cost is NIS 1000.

5. Investigative material

Have you been indicted? Take copy of the police file and learn what the rest of the case has to say in the investigation, as well as the rest of the evidence in the case. In the police file are testimonies of drivers and witnesses outside vehicles. An accident file usually includes the findings of the traffic examiner who visited the scene of the accident with engineering findings, calculations of vehicle speed distances, braking marks and so on.

6. The insurance company can pay your attorney

if you paid the attorney for representation in a traffic court the sum can be covered by the insurance company.

7. The first hearing – a reading session

There is a difference between a reading session and a proof meeting. At the first meeting you will not have to bring witnesses and confront the policeman. If you are at fault, the court will set a hearing to prove it. If the court admits the court will turn to hearing arguments for punishment. At the stage of the arguments for punishment, it is useful to provide evidence of personal situation, children, health and mobility problems, especially employment, and whether the vehicle is used for livelihood needs. The dependence of family members on your mobility is also relevant.

8. Have you been disqualified? Deposit your driving license

A license deposit is made at the Traffic Court Secretariat. You get the license back at the ministry of transportaion branch. If you still decide to revoke your license, make sure that the driver’s license is deposited, as otherwise the term of the disqualification days will not begin. You can get the license for the term of the disqualification period at the licensing office.

9. Appeal

You can do this within the time specified in the judgment (within 45 days) to the District Court.
